No material from the site may be copied, reproduced, republished, uploaded, posed, transmitted, or distributed in any way, except that you may download one copy of the materials on any single computer for your non-commercial use only, provided that you keep intact all copyright and other proprietary notices. Modification of the materials or use of the materials for any other purpose is a violation of Wawathai.co.uk copyright and other proprietary rights. The use of any such material on any other web site or networked computer environment is prohibited. Wawathai.co.uk also assumes no responsibility, and shall not be liable for any damages to, or viruses that may infect your computer equipment or other property on account of your access to, use of, or browsing in the site or your downloading of any materials, data, text, images, video, or audio from the site.

Wawathai.co.uk may use anything you transmit or post for any purpose, including but not limited to reproduction, disclosure, transmission, publication, broadcast, and posting.

Registration

To be able to access our online services like reserve table, order online, you must first register an account with us.

If your postcode is too far away you will not be allowed to order online delivery but you can still order a collection, or use telephone services to order which you must collect. Our location can be found on our contact page.

By placing an order through our site, you warrant that:

(a) you are legally capable of entering into binding contracts; and

(b) you are at least 18 years old.

Online Ordering

We reserve the right to refuse your order should it be necessary.

Payment
Card payments are secure.

3.Debit Cards, such as Visa, Delta, Maestro or Switch are accepted.

4.In the event of wawathai.co.uk needing to issue a refund we will endeavour to credit your account within 21 working days.

5.The owner of the card used to make payment must present this card on receiving the order.

Card payments are secure.

Wawathai.co.uk do not accept cheques, Diners Club or other means of payment other than those detailed above.

Upon submitting your order details, you are making an offer to us to purchase the item(s) you have specified in your order form.

We reserve the right to refuse your offer should it be necessary.

Products

All products are subject to availability.

Some products contain nuts – if in doubt please contact us through our Contact Page.

Although great care has been taken to remove all bones from fish, meat some may remain.

Promotions and Discounts

When submitting your order details you may wish to offer to purchase the items specified in conjunction with a particular offer or promotion. To take advantage of this facility you will need to enter the appropriate promo code with your order details. These codes are presented on our menu and other items of promotional literature from time to time.

Any such order will be subject to the specific terms and conditions of the promotion in question and will be subject to availability. We reserve the right to refuse or withdraw any wawathai.co.uk promotion or discount at any time.

Consent

By submitting your information you consent to the use of that information as set out in our Privacy Policy Statement.

Your Order Confirmation

Your Order Confirmation is a record of our agreement to deliver the products ordered and paid for in full. If someone else made the booking on your behalf, you agree that such person acted as your agent.

Amendments to Orders

Amendments to the order or delivery time can be made no later than 10 min prior to the start of the delivery window or collection booked. Amendments to the content of your order can be made up to 20 min before the delivery window or collection begins.

Amendments to the order must be made by phoning the Restaurant.

The delivery time slot may be altered up to 1 hour before the start of your order window. The order can only be changed to a new time slot if it is available.

Order Restrictions

Online Orders for delivery will only be accepted from addresses with postcodes which lie within our delivery area as determined by our postcode finder (subject to a minimum delivery order value – please refer to our Delivery Charges).

Online Orders may only be placed during the Online Ordering Service opening times which are clearly displayed on our Menu pages.

Customer Responsibilities

It is the customer responsibility to enter the delivery address in full to ensure the driver may locate the correct property for delivery. Failure to deliver due to incorrect address details will be charged in full.

You must ensure that delivery can be made to the address during the selected window. If we are unable to make delivery at the given address in the selected time slot then we will deem the order cancelled at full cost.

No rescheduling of time will be permitted.

In the case of addresses that are irregular or difficult to locate, it is the responsibility of the customer to clearly mark special delivery instructions in the box required (Notes) Failure to do so may result in a delayed delivery, or the order being cancelled by wawathai.co.uk.

Deliveries

Delivery Information
Our aim is to provide the fastest delivery service possible. Unfortunately things don’t always go to plan and factors, such as weather and traffic conditions, occasionally prevent us from achieving this.

We shall have no liability whatsoever for any delay or failure to deliver to you where such delay or failure is caused by a circumstance beyond our reasonable control. Such circumstances include, but are not limited to;
• Unforeseen Traffic Delays
• Accidents Causing Delays on the Service Route
• Severe Weather Conditions.

Delivery Charges (up to 0.5 miles) subject to a minimum order value of £60.00 Delivery is FREE

All orders below the minimum order value (excluding delivery charges) must be collected.

There is no minimum order value for orders which are to be collected.

Delivery is only available to qualifying postcodes within a 2 mile radius of our premises which are at 50 Paddington Street, London, W1U 4HP .

All online customers whose postcodes lie within our delivery area are given the choice of “Home Delivery” or “Customer to Collect” when confirming their order in the checkout. Customers whose postcodes lie outside of our delivery area MUST COLLECT THEIR ORDER – this is the only delivery option available to them.

We aim to have Home Delivery orders delivered within 45 minutes of the customer placing an order (depending on distance and time of day) , and Collection orders ready to collect within 20 minutes. During busy periods these times may vary, if there is a significant delay where possible we will contact you.

Cancellations

You have the right to cancel an order within a reasonable time (which is usually a matter of minutes) and before the order has been processed. An order will be classified as being processed as soon as food has been used to start preparing the order.

Customers can cancel an order by telephoning the store to cancel the order. Our telephone number can be found on our Contact Page.

Any order cancelled after the order has been processed will be classified as a “Bad Order” and will be charged to the customer, and no refund will be given.

Any orders cancelled in accordance with these cancellation provisions and before the order has been processed will not be charged.

Any payment made prior to an order being cancelled within the specified time will be reimbursed using the same method as used by the customer to make the payment.

We will endeavour to issue a refund to your credit card account within 21 working days.

Your Personal Data

You agree that personal data may be retained, used and disclosed by us and our agents for the purpose of complying with our obligations under these Terms and Conditions for delivery including, but not limited to, administering your order and complying with any legal obligations.

Our Liability

To the extent permitted by law, Thai2u ltd provides this site and content on an “as-is” and “as available” basis and makes no representation or warranty of any kind, express or implied, regarding the content or availability of our site, or that it will be timely or error-free, that defects will be corrected, or that our site or server that makes it available are free of viruses or other harmful components.

Our liability for losses you suffer as a result us breaking this contract, including deliberate breaches, is strictly limited to the purchase price of the Product(s) you order.

Under no circumstances, including, but not limited to, negligence, shall wawathai.co.uk be liable for any special or consequential damages that result from the use of, or the inability to use, the materials in this site, even if wawathai.co.uk  authorised representative has been advised of the possibility of such damages. In no event shall wawathai.co.uk have any liability to you for damages, losses and causes of action (whether in contract, tort (including, but not limited to, negligence), or otherwise) for accessing this site.

Termination

We reserve the right to decline a new registration, terminate your right to link to our site, remove you as a user of our site, and/or prevent any further use if you breach any of your obligations under these terms and conditions.

If we terminate your right to link to our site you must cease linking to our site immediately. We reserve the right to assign or sub-contract any or all of our rights and obligations under these terms.

Communication

Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website.

For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.

This does not affect your statutory rights.  We reserve the right to revise and amend these terms and conditions from time to time.

You will be subject to the policies and terms and conditions in force at the time that you order Product(s) from Thai2u ltd, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before you are presented with the Confirmation Screen.

We also reserve the right to alter, amend or withdraw prices and special offers without notice, although any changes will not affect orders which have gone through the Confirmation Screen.

Contracts for the purchase of products through this site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

Estimated times for deliveries and collections are provided by the Restaurants and are only estimates. the Restaurant cannot guarantee that Orders will be delivered or will be available for collection within the estimated times.
